Terms of Use
Autism CRC Ltd ABN 55 162 632 180 (Autism CRC, we, our, or us) is the owner and operator of the myWAY Employability online collaborative career planning web platform which is operated through https://www.mywayemployability.au.
1. How does this Agreement apply?
1.1 How to accept this Agreement
This Agreement governs your use of the Platform. By clicking “I agree”, you agree to be bound by these Terms of Use from the Effective Date until this Agreement automatically terminates in accordance with clause 3.3 (Deactivating your Account).
If you are a Professional User, by clicking “I agree” you also agree that your Agreement with us comprises of these Terms of Use as well as the Professional User Terms available at https://www.mywayemployability.au/subscription-terms
What happens after the end of this Agreement?
- Once this Agreement terminates:
- you may no longer access the Platform and the rights granted to you at clause 5.1 are immediately revoked; and
- unless you tell us to delete your Data before deactivating your Account, we may keep copies of, and continue to use, your Data.
- The following provisions survive termination of this Agreement: this clause 1.1(b) and clauses 2.3(b) (For Users younger than 18), 7.1(d) (Licence to use your Data), 9 (Autism CRC’s liability), 10 (Indemnity) and 12 (Other important items).
1.2 When Autism CRC can make changes to this Agreement
- Autism CRC may update this Agreement at any time by displaying the amended Agreement on the Platform. We will do our best to notify you of any change to this Agreement.
- If you do not agree with the amended Agreement, you may deactivate your Account and terminate this Agreement in accordance with clause 3.3(b) within 7 days of our publication of the amended Agreement. If you do not terminate this Agreement, you will be deemed to have accepted and agreed to the amended Agreement.
2.1 Registration is required
In order to access and use the Platform, you must complete the user registration form on the Platform. Once you register, you will be provided with an Account.
2.2 Who can register
You must be at least 14 years old to create an Account and use the Platform. If you are a Career Explorer and are under 18 years old, clause 2.3 will apply to your access and use of the Platform.
2.3 For Users younger than 18
- If you are under the age of 18, this Agreement is agreed by and entered into by your parent or legal guardian on your behalf and for the purposes of clause 2.3(b):
- “You” or “Your” is a reference to that parent or guardian; and
- “User” means the person under the age of 18 that will use the Platform and is the child or ward of the parent or legal guardian described in this clause 2.3(a).
- You understand and agree that:
- you are bound by this Agreement on behalf of the User;
- the User may create an Account and use the Platform subject to your consent and provided that you ensure that the User complies with this Agreement;
- you are responsible for the acts and omissions of the User in respect of the Platform, as though you committed such acts and omissions;
- you indemnify Autism CRC (and any of our Related Entities, Related Bodies Corporate and each of their directors, officers, employees and agents) against any Loss, Claim or Liability arising out of or in relation to the User’s breach of this Agreement;
- we may enforce this Agreement against you for any acts or omissions of the User; and
- regardless of any other provision in this Agreement, you may access or use the Platform or an Account on behalf of, or for the benefit of, your child or ward.
3. Your Account
3.1 You are responsible for your Account
- You acknowledge and agree that you are solely responsible for:
- all activity that occurs in and through your Account, including any unauthorised activity;
- keeping your Account secure, including keeping all passwords and other security information confidential; and
- ensuring that Data complies with these this Agreement and all applicable Laws, and does not cause Autism CRC to breach or fail to comply with its obligations under any applicable Law.
- Subject to clause 2.3, you must:
- only use the Platform through your Account;
- not permit another person to use the Platform with your Account; or
- not use the Platform on another user’s Account, even if you also have an Account.
3.2 Autism CRC may suspend your Account
- Autism CRC may disable or restrict your Account if:
- Autism CRC finds that you have breached this Agreement;
- required by Law; or
- a Force Majeure Event occurs.
- If your Account is disabled or restricted in accordance with this clause 3.2, the restriction will continue until we are satisfied (in our absolute discretion) that the circumstances that caused the suspension or restriction are resolved.
- Your obligations under this Agreement continue even if your Account is disabled or restricted, but only if those obligations are not affected by the restriction.
3.3 Deactivating your Account
- We may terminate your access to the Platform and permanently deactivate your Account immediately by notifying you, if:
- you have breached this Agreement and the breach cannot be fixed, or if the breach can be fixed, you have not fixed the breach within 7 days of receiving notice from us identifying the breach and requesting you to fix the breach;
- required by Law; or
- it is no longer commercially viable for us to provide you the Platform.
- You may deactivate your Account at any time by following the process set out in the User Guide or Platform.
- Once your Account has been deactivated this Agreement terminates immediately.
4. Autism CRC is not responsible for the security of your Data
- Autism CRC will never ask you to send your password or other sensitive information via email or enter it into any website other than through the Platform. If you ever suspect that someone else has used your Account without your permission or your password is no longer a secret or private, you must immediately change your password and contact us.
- Data sent, provided or received over the internet or mobile phone networks is not secure, and we do not warrant, and cannot ensure, the privacy, security or integrity of your Data, including through the normal functioning of the Platform. You send, share and provide data using the Platform entirely at your own risk. You agree that we will not be liable for any damage or loss caused as a result of any lost Data.
- If you comply with this Agreement and create an Account, Autism CRC grants you a right to access and use the Platform for your personal use. You agree that this right:
- is only valid until this Agreement ends;
- may be provided by Autism CRC to other people and organisations;
- does not require you to pay us any money; and
- does not allow you to:
- transfer or give your right to use the Platform to other people or organisations;
- share your right to use the Platform with other people;
- grant other people the right to use the Platform;
- use the Paid Content;
- use the Platform for commercial or business purposes (unless otherwise agreed by you and Autism CRC in writing); or
- change or share the Content in any way.
- You agree that some features of, or content in, the Platform are made for certain types of Users and may not be available to you.
5.2 How we maintain the Platform
- Autism CRC will do our best to make the Platform available to you and respond to any technical or service support questions you have relating to the Platform.
- Despite clause 5.2(a), you understand and agree that your access to, or use of, the Platform may be disrupted at any time, including as a result of:
- any malfunction, network outage or error;
- any updates, upgrades, maintenance or repair of the Platform by us or our subcontractors; or
- a Force Majeure Event.
You are solely responsible for complying with any Laws that may apply to your use of our Platform. In using the Platform, you must not (and must not allow, enable or permit any other person to):
- use the Platform for any purpose other than for your own personal use;
- cause harm or loss to anyone;
- sell access to, or information from, the Platform;
- reproduce, adapt, duplicate, rent, copy, sell, trade, resell, distribute or exploit the Platform or any part of the Platform unless the Agreement specifically allows you to;
- take any action that damages, slows down, disrupts or negatively affects the performance or proper functioning of the Platform;
- take any action that could slow down, disrupt, or negatively affect the performance or proper functioning of the Platform;
- use the Platform in a way that is unreasonable, unlawful or is likely to harm the integrity of the Platform;
- interfere (or attempt to interfere) with the working of the Platform;
- get around (or attempt to get around) any security or authentication measures of the Platform or any other system, network or server connected to the Platform;
- avoid, bypass, remove, deactivate, impair, descramble or otherwise attempt to get around any technological measure that protects the Platform (e.g., the password requirements);
- use the Platform in a manner that is defamatory, fraudulent, false, misleading or deceptive, malicious, offensive or harmful, or that violates another person’s or entity’s rights (including Intellectual Property Rights and rights to confidentiality and privacy);
- copy, store, access or use any information of other Users in a way that is inconsistent with our Privacy Policy or this Agreement, or that otherwise violates the privacy rights of other Users or third parties;
- offer or provide products or services that you do not own or have the authority or permission to offer or provide through the Platform;
- engage in phishing or identity theft;
- provide content or information that may pose a personal safety risk to any User;
- post content that defames or slanders any other User or their goods or services;
- breach or avoid any Laws, agreements with third-parties, third-party rights or this Agreement;
- impersonate another person or entity, including a representative of Autism CRC;
- use the Platform in a way that falsely implies that you are endorsed by Autism CRC, affiliated with Autism CRC, or are a partner of Autism CRC;
- post advertising or other commercial content unless expressly permitted by Autism CRC;
- dilute, tarnish or otherwise harm the “Autism CRC”, “my WAY” or “myWAY Employability” brands in any way, including through unauthorised use of other Users’ Data, registering, applying to register and/or using “Autism CRC”, “my WAY” or “myWAY Employability” or any of our other trade marks, or any substantially identical or deceptively similar words, in any domain names, business names, company names, trade marks or other source identifiers;
- post or upload any sexually explicit content;
- discriminate against or harass anyone on the basis of race, national origin, religion, gender, gender identity, physical or mental disability, medical condition, marital status, age or sexual orientation;
- engage in any abusive or disruptive behaviour;
- allow or assist any third person to access or use the Platform, or grant any third person unauthorised access to use the Services;
- use the Platform to distribute unsolicited commercial messages (“spam”);
- menace, harass, offend or cause annoyance to any person (including other Users);
- promote or facilitate violence or terrorist activities;
- use any robots, spider, crawler, scraper or other automated means or processes to access, collect data or other content from the Platform for any purpose;
- distribute computer viruses, worms, bugs, Trojan horses or other malicious code; or
- attempt to decipher, decompile, disassemble or reverse engineer any of the software or source or object code used to provide Platform.
5.4 Using third party links
The Platform may include links to third-party websites and other online resources (including materials made available by other Users). The presence of these links does not mean that Autism CRC has a relationship with those third parties or that Autism CRC endorses those third parties, their products, services or websites.
If you click or use these third-party links, this is done entirely at your own risk and is subject to the terms of those third-party websites.
6. Intellectual Property Rights
- You agree that Autism CRC owns or is licensed to use all Intellectual Property Rights in the Platform (including in all underlying source code) and in the Content.
- You do not have any licence, right, title or interest in or to Our IP under this Agreement. Nothing in this Agreement or on the Platform should be taken as Autism CRC providing you any such licence, right, title or interest.
- You must not (and must not allow, enable or permit any other person to):
- commercialise or exploit Our IP without our prior written permission (except where permitted under the Copyright Act 1968 (Cth) for research or study);
- use Our IP in any way that could damage our reputation or infringe our Intellectual Property Rights; or
- use or register the words, “Autism CRC”, “myWAY”, “myWAY Employability”, “myWAY PRO” or any other trademark used, company name, business name or domain name used by Autism CRC.
7. Data and Content
7.1 Autism CRC will own your Data
- You irrevocably assign to Autism CRC all right, title and interest (including all Intellectual Property Rights) in your Data, except if the Data is your Personal Information. You retain ownership of your Personal Information.
- To the extent that any Moral Rights subsist in your Data, you:
- expressly consent to Autism CRC’s (and any of its licensees, assigns, successors and any of its authorised users) use of your Data, even if such use would infringe your Moral Rights in the Data; and
- waive your right to bring any Moral Rights claim against Autism CRC or any third party; and
- must obtain the express consent of, and a waiver from, any other individual that has contributed to the Data and holds Moral Rights in respect of such Data, within the same parameters of the consent and waiver you provide us under clause 7.1(b)(i) and 7.1(b)(ii).
- You warrant that your Data is not fraudulent or defamatory and will not breach any Law or third-party rights.
- Autism CRC grants you a licence to use your Data, which:
- continues after the end of this Agreement;
- may be provided to other people and organisations;
- does not require you to pay us any money in return; and
- allows you to:
- grant other people a licence to use your Data under the same conditions described in this clause; and
- use, copy, change, publish or share your Data for any personal purposes anywhere in the world.
- Autism CRC may collect, use, store, disclose and otherwise handle your Personal Information in accordance with our Privacy Collection Statement and Privacy Policy (as updated from time to time).
7.2 Our use of your Data
- You represent and warrant that:
- you have the ability to make the assignment in clause 7.1(a) above and that nothing further is required to complete that assignment; and
- our (or any of our licensees’, assigns’, successors’ or authorised users’) use of your Data will not infringe any rights (including any Intellectual Property Rights) of any person.
- Subject to clause 7.1(e), you acknowledge and agree that Autism CRC may:
- use and alter the material in your Data by adding to, selecting elements from, or rearranging elements of, the material. For example, by combining elements of your Data with any other material; and
- use the material without having to acknowledge you as the author of your Data. For example, by using your Content in material branded or marked as authored by Autism CRC or one of our partners.
7.3 We may remove your Data from the Platform
You acknowledge and agree that we may, in our sole discretion, immediately remove any Data from the Platform which we think may be defamatory, malicious, offensive, unlawful, harmful or otherwise unsuitable for the Platform.
8. Disclaimers
8.1 We make no commitments regarding the Platform
You acknowledge and agree that the Platform is provided on an ‘as is’ basis and to the fullest extent possible and subject to any liabilities and obligations which cannot be excluded by Law, we make no warranty, representation or guarantee:
- that the functions contained in the Platform will meet your requirements;
- the accuracy or completeness or reliability of the Platform or the Data of other Users available through the Platform; or
- that:
- your access to the Platform or any part of the Platform will be uninterrupted or error free; or
- defects will be corrected or that the software or the server that makes it available are free of viruses, bugs or malicious code or other forms of interference which may damage your device.
8.2 Any implied warranties are excluded
All conditions, warranties, guarantees, rights, remedies, liabilities and other terms implied by statute, custom or the common law including but not limited to warranties of accuracy, completeness, non-infringement, or usefulness of the Platform, are excluded from this Agreement.
9. Autism CRC’s liability
9.1 Things that we are not responsible for
To the fullest extent permitted by Law, Autism CRC is not liable for, or in relation to:
- any loss or damage that you incur from your use of the Platform (including damage to your software or hardware, corruption of data or loss of data); or
- any action or inaction taken in reliance on the Platform or any information contained on the Platform;
- any losses or delays in sending or receiving of messages or information using the Platform;
- any losses or delays due to a malfunction of services, facilities, software, hardware or products which cannot reasonably be considered to be under our control;
- any unauthorised use or interception of any message or information;
- any Claims made by third-parties (including other Users) resulting from your use of the Platform; or
- any Consequential Loss, including as a result of a reduced level of service caused by a third party, or loss or corruption of data or information arising out of or related to your use or inability to use the Platform.
9.2 Our maximum liability
In the event Autism CRC is found liable for any Loss, Claim or Liability under or in connection with this Agreement, then to the full extent permitted by Law, Autism CRC’s liability (including under any statute, tort, negligence, contract or our indemnity obligations at clause 10) is limited to $100.
9.3 Our maximum liability under the ACL
If a supply under this Agreement is a supply of services to a consumer within the meaning of the ACL, nothing contained in this Agreement affects the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the ACL, provided that, to the extent that the ACL permits us to limit our liability, then our liability will be limited to the:
- resupply of the services; or
- payment of the cost of resupplying the services.
10. Indemnity
Each party indemnifies the other party (and their Related Entities, Related Bodies Corporate and each of their directors, officers, employees and agents) against any actions, claims, liabilities, losses, damages, costs and expenses (including, without limitation, reasonable legal fees and disbursements and costs in investigation, litigation, settlement, judgment, interest, fines and penalties) which any of them incur directly or indirectly arising from:
- if you are the indemnifying party, your use of the Platform or your breach of this Agreement;
- if Autism CRC is the indemnifying party, our breach of this Agreement.

12. Other important items
12.1 Providing notice
- A notice, consent, approval or other communication under this Agreement (Notice) must be in writing and signed by the sender or its duly authorised representative, addressed to the recipient and sent to the recipient’s email address.
- The particulars for delivery of Notices are as follows:
- for Autism CRC: the details specified at clause 11; and
- for you: the contact details specified in your Account.
12.2 Relationship between you and Autism CRC
This Agreement does not create any agency, partnership, joint venture, employee-employer or other similar relationship whatsoever between Autism CRC and a User.
12.3 Legal costs
Except as expressly stated otherwise in this Agreement, each party must pay its own legal and other costs and expenses of negotiating, preparing, executing and performing its obligations under this Agreement.
12.4 All proceedings to be brought in Queensland
- This Agreement is governed by and is to be construed in accordance with the laws applicable in Queensland, Australia.
- Each party irrevocably and unconditionally submits to the non-exclusive jurisdiction of the courts of Queensland, Australia and any courts which have jurisdiction to hear appeals from any of those courts and waives any right to object to any proceedings being brought in those courts.
12.5 Severability
- Subject to clause 12.5(b), if a provision of this Agreement is illegal or unenforceable in any relevant jurisdiction, it may be severed for the purposes of that jurisdiction without affecting the enforceability of the other provisions of this Agreement.
- Clause 12.5(a) does not apply if severing the provision materially alters the:
- scope and nature of this Agreement; or
- the relative commercial or financial positions of the parties; or
- would be contrary to public policy.
12.6 Each party must take necessary steps
Each party must promptly do whatever any other party reasonably requires of it to give effect to this Agreement and to perform its obligations under it.
12.7 How to provide consentzoom
Except as expressly stated otherwise in this Agreement, a party may conditionally or unconditionally give or withhold consent to be given under these Terms and is not required to give reasons for doing so.
12.8 What is the nature of each party’s rights?
Except as expressly stated otherwise in this Agreement, the rights of a party under the Agreement represent all of that party’s rights and are in addition to any other rights of that party.
12.9 What happens when I or Autism CRC exercises or waives its rights?
- If a party exercises (whether wholly or partially) or waives any of its rights relating to this Agreement, this does not prevent that part from further exercising that right or any other right.
- A party is not liable for any loss, cost or expense of any other party caused or contributed to by the waiver, exercise, attempted exercise, failure to exercise or delay in the exercise of a right.
12.10 Can this Agreement be transferred?
- You must not assign or transfer any rights or obligations under this Agreement without the prior written consent of Autism CRC.
- Autism CRC may assign or transfer any rights or obligations under this Agreement without your consent.
- Any purported dealing in breach of this clause is of no effect.
12.11 What is in this Agreement?
This Agreement may consist of a number of counterparts and, if so, the counterparts taken together are one agreement.
12.12 What happens to the previous myWAY terms I agreed to?
- This Agreement contains the entire understanding between the parties as to the subject matter of this Agreement.
- All previous negotiations, understandings, representations, warranties, memoranda or commitments concerning the subject matter of this Agreement are merged in and superseded by the Agreement and are of no effect. No party is liable to any other party in respect of those matters.
13. Definitions and Interpretation
13.1 Definitions
- Account: means an account to use the Platform.
- Agreement: means these Terms of Use and any other document that forms part of this Agreement (as agreed by the parties in writing).
- ACL: means the Australian Consumer Law as contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
- Claim: includes a claim, notice, demand, action, proceeding, litigation, investigation, judgment, damage, Loss, cost, expense or liability however arising, whether present, unascertained, immediate, future or contingent, whether based in contract, tort or statute and whether involving a third party or a party to this Agreement.
- Consequential Loss: means any loss or damage that is special, exemplary, indirect or consequential, including (without limitation) any loss of profit, loss of revenue, loss of contract value, loss of opportunity, loss of data, damage to reputation, loss of goodwill, or service disruptions.
- Content: means all databases, features, functionalities, information, materials, reports, graphics, templates or layouts made available by Autism CRC through the Platform, but excludes the Data.
- Data: means any information, data or materials provided or created by or on behalf of a User in the course of accessing or using the Platform, including (without limitation) the information a User provides on their Account, but excludes the Content.
- Effective Date: means the date this Agreement is accepted in accordance with clause 1.1.
- Explorer: means an individual that creates an Account as an "Explorer" on the Platform.
- Force Majeure Event: means an event or circumstance beyond the reasonable control of the parties which results in a party being unable to observe or perform its obligations under this Agreement, including without limitation:
- any acts or omissions by other Users;
- adverse changes in Law;
- any acts of God;
- earthquakes, lightning strikes, floods, storms, explosions, fires or any natural disaster;
- acts of public enemies, terrorism, riots, war;
- cyber attacks, viruses or malware, network outages; or
- strikes or industrial disputes.
- Free Content: means the Content accessible on a complimentary basis.
- Intellectual Property Rights: means all current and future intellectual and industrial property rights and interests throughout the world, whether registered or unregistered, including patents, trade marks, domain names, design rights, copyright, trade secrets, know how, applications for them and licences or consents in relation to them, and any moral rights arising under Part IX of the Copyright Act 1968 (Cth).
- Law: means any statute, ordinance, regulation, rules or other legislation in force in any jurisdiction, that applies to the rights and obligations under this Agreement.
- Liability: means any liability or obligation (whether actual, contingent or prospective) including any Loss, irrespective of when the acts, events or things giving rise to the liability or obligation occurred.
- Loss: includes any loss, damage, cost, charge liability (including tax liability) or expense (including legal costs and expenses).
- Moral Rights: has the meaning given to that term under the Copyright Act 1968 (Cth).
- Organisation: means a body corporate, organisation or any other legal entity carrying on a business, including a corporation or body corporate as defined under the Corporations Act 2001 (Cth).
- Our IP: means all Intellectual Property Rights owned or held by, or licensed to, Autism CRC independently of this Agreement, including the Intellectual Property Rights subsisting in the Platform and the Content.
- Paid Content: means the Content available exclusively to individuals or an Organisation that holds a paid subscription to access or use the Platform.
- Personal Information: has the meaning given to that term under the Privacy Act 1988 (Cth).
- Platform: means the myWAY web platform described at the beginning of this Agreement and Content, and includes any and all updates, versions, patches, upgrades or modifications to such platform and Free Content.
- Professional User Terms: means the terms available at: [insert link]
- Professional User: means an individual or Organisation that holds an Account as a "Professional User".
- Related Body Corporate: has the meaning given to that term under the Corporations Act 2001 (Cth).
- Related Entity: has the meaning given to that term under the Corporations Act 2001 (Cth).
- Terms of Use: means these terms and conditions.
- User (you or your): means the individual or Organisation that has created an Account and to whom this Agreement applies.
- User Guide: means any information, guidelines, specifications, manuals or other materials made available by Autism CRC in respect of the Platform, including as available on the Website.
- Website: means the website available at https://www.mywayemployability.au.
13.2 Interpretation
- a reference to:
- the singular includes the plural and the plural includes the singular;
- a recital, clause, schedule or annexure is a reference to a clause of or recital, schedule or annexure to the Agreement and references to the Agreement include any recital, schedule or annexure;
- any contract (including this Agreement) or other instrument includes any variation or replacement of it and as it may be assigned or novated;
- a statute, ordinance, code or other law includes subordinate legislation and other instruments under it and consolidations, amendments, re-enactments or replacements of any of them;
- a person or entity includes an individual, a firm, a body corporate, a trust, an unincorporated association or an authority;
- a person includes their legal personal representatives, administrators, successors, substitutes and permitted assigns;
- an entity which has been reconstituted or merged means the body as reconstituted or merged, and to an entity which has ceased to exist where its functions have been substantially taken over by another body, means that other body;
- a reference to a day or a month means a calendar day or calendar month;
- money (including ‘$’, ‘AUD’ or ‘dollars’) is to Australian currency;
- unless expressly stated, no party enters into the Agreement as agent for any other person;
- the meaning of any general language is not restricted by any accompanying example;
- the words ‘costs’ and ‘expenses’ include reasonable charges, expenses and legal costs on a full indemnity basis;
- headings and the table of contents are for convenience only and do not form part of the Agreement or affect its interpretation;
- if a period of time is specified and dates from a given day or the day of an act or event, it is to be calculated exclusive of that day;
- where there are two or more persons in a party each are bound jointly and severally;
- a provision of this Agreement must not be construed to the disadvantage of a party merely because that party was responsible for the preparation of the Agreement.

In this privacy collection statement, Autism CRC, we, us and our refer to Autism CRC Ltd ABN 55 162 632 180 and its Related Entities (having the meaning given in the Corporations Act 2001 (Cth)).
This notice explains how we handle personal information. Please read this statement carefully as it will have important consequences for you in relation to the collection, use and disclosure of personal information you provide to us when using the myWAY Employability platform (Platform) operated at https://www.mywayemployability.au (Website).
By clicking “I accept” or using the Platform, you confirm that you have read this collection notification statement and consent to your personal information (including sensitive information) being collected, used and disclosed in accordance with this statement and as otherwise detailed in our Privacy Policy.
1. Why do we collect, use and disclose information
We generally collect, use and disclose personal information (including sensitive information) to facilitate your use of the Platform and Website. In particular, to:
- create your user account;
- connect you with other users of the Platform;
- respond to your questions and any complaints you may have in relation to the Platform;
- improve and enhance the Platform and our products and services;
- analyse your use of the Platform and our products and services so we may accommodate that use;
- monitor your use of the Platform for purposes such as, compliance or service or product improvement purposes;
- if you are an explorer user, produce reports for sharing with professional users (i.e., your supporters);
- if you are a professional user, facilitate payment of your subscription fees and connect you with other professional users supporting the explorer user;
- offer you updates regarding the Platform or our other products or services, events or information that may be of interest to you; or
- conduct marketing and promotional activities (including by direct mail, telemarketing, email or via our newsletter).
We may also collect, use and disclose personal information for research or for our internal administrative purposes.
If you do not agree to provide the personal information we request, then we may be unable to provide you with our products and services (such as access and use of the Platform) or the quality of our products and services may be compromised. However, there will not be any other consequence for you.
The types of information we collect will generally depend on how you use the Platform.
2.1 Professional user information
If you use the Platform only as a professional user, we will generally only collect your name, email address, pronouns, employment status and education level. We may also collect information about the organisation you are with (if any).
2.2 Explorer user information
If you register as an explorer user of the Platform, we will generally collect information about you including but not limited to:
- your name, pronouns, contact details, (if you are under the age of 18) the name of your parent or legal guardian and their contact details;
- your sensitive information, namely, details regarding your disability (such as, any particular sensitivities, communication style, sensory preferences, medical conditions) that are relevant to your employment journey;
- the information that you provide when you register and use the Platform such as, details about your education, skills and attributes, sensory and environmental observations, employment history, career goals, and your reflections and self-assessments about your achievements and experiences related to your use of the Platform.
However, we will only collect sensitive information with your consent and where it is reasonably necessary for our activities, or if the collection is required by law or a court or tribunal order.
We may also collect information about the way in which you (whether as a primary user or supporter) use the Platform, information about the users that you interact with and other information as part of managing your use of the Platform and our services.
3. Method of collection
We will generally collect your personal information from you, but at times we may collect personal information about you from others where it is impracticable or unreasonable to collect it directly from you. For example, if you are under the age of 18 years old, we may collect personal information about you from your parent or guardian or from your health professional who refers you to the Platform. Another example is where you are nominated as a "supporter" for a Platform user or a "professional user", in which case we will initially collect personal information about you from the Platform user who nominates you, before you sign up as a Platform user yourself.
If you provide us with personal information about another person, you represent, and we collect it, on the basis that you have that person's consent for us to collect and handle their personal information in accordance with this Privacy Collection Statement.
4. Disclosure of personal information to others
When you use the Platform certain personal information and (if you are an explorer user) sensitive information about you may be disclosed to other individuals or organisations, such as:
- our related entities and bodies corporate;
- our service providers and partners who assist us with delivering our products and services (including the Platform) such as, our IT service providers;
- our professional advisers (e.g., lawyers and accountants);
- law enforcement officers, regulators, courts and government agencies, if permitted or required:
- by law, regulation, court order or other legal process;
- to assist in the prevention or detection of crime;
- to prevent a threat to any person's life, health or safety;
- any purchaser or prospective purchaser of our business, including in the case of bankruptcy, a merger, acquisition, reorganisation, sale of assets or assignments, or due diligence in respect of any such transactions;
- if you are a primary user: to your nominated supporters or professionals that are part of your career planning team and has access to the Platform; or
- as a supporter of an individual: other supporters and/or professionals of the primary user you are supporting.
5. Overseas disclosure of personal information
We work with people or companies that are located outside of Australia, who assist us with providing our products and services to you. Those people or companies may accordingly use or store your personal information outside of Australia (such as, in the United States) in the course of providing this assistance. However, they will only do so if you have consented to us sharing your personal information with them to use or store or if we are legally required or authorised to share your information with them.
By providing us with your personal information and clicking "I agree", you consent to us (including through our service providers) using, transferring, storing, processing or disclosing your personal information outside of Australia. In providing this consent, you understand and acknowledge that:
- Australian Privacy Principle 8.1 does not apply to our disclosure of your personal information; and
- countries outside of Australia do not always have the same privacy protection obligations as Australia in relation to personal information. However, we take reasonable steps to ensure that any third parties based outside Australia to whom we disclose or share your personal information, uses and holds your personal information in a secure manner.
